These Terms explain the rights and obligations of all users (hereinafter referred to as You) and the rights and obligations of NeO Albania (hereinafter referred to as We) regarding the service/items provided by us through this site. Before you authorize the execution of the order, please read these Terms and the privacy statement carefully. By using our portal and authorizing the placing of the order you have automatically agreed to our Terms and Conditions. If you do not agree with these Terms please do not order from our portal.

Using the Online Portal

The Terms and Conditions are important both to you and to us. These Terms are designed to bind us into a contractual agreement, to protect your rights and our rights as a business. At the time of placing the order, you agree to these Terms.

You agree that:

a. You may use this online site to perform activities related only to the purpose of this portal.

b. You will not place any incorrect or malicious orders. If we see that such an order has been placed, we have the right not to send the goods to the destination specified by you.

c. You are also obliged to provide us with details such as first name, last name, phone number and correct address. These details serve us to identify and connect with you when we want to deliver the order.

d. If you do not provide us with accurate or complete information, we may not be able to fulfill your order.

By placing an order on our online portal, you warrant that you are over 18 years of age and of legal age to enter into a contractual relationship with us.

Service Availability

We can ship items throughout Albania, Kosovo and North Macedonia.

How is the contract between us formed?

The information detailed in the Terms and Conditions does not constitute an offer to sell but constitutes an invitation by us for you to order. The contract does not take effect unless we approve your order. We will send you an email confirming that you have placed an order, however this does not mean that we will send you the goods if we judge that the fulfillment of the order is illegal or if the order does not comply with the Terms and the Terms described herein. The contract comes into force the moment the ordered item/s leave the NeO Albania warehouse to come to you.

Availability of Items

All orders for our items are subject to availability on our part and therefore in the event that we have a problem supplying you with the ordered item or if the item is out of stock despite it continuing to be advertised on the portal, we reserve the right to right to share this information with you and to offer you another item of the same or higher quality and value as the missing item you pre-ordered. If you do not want the replacement item provided by us, you will have no obligation to continue ordering with us.

Rejection of Order

We reserve the right to remove items from the online ordering portal at any time and reserve the right to add/remove or update any material or content of this portal. Although we will do our best to complete every order with you, there may be exceptional circumstances which lead us to refuse your order, which we reserve the right to do at any time.

We have no liability to you or to third parties if we judge that we should refuse an order or if we remove items from our portal. We have no obligations to anyone if we remove, add, update our materials or products on the online portal.

Your right to return the item(s) ordered

As a customer, you have the right to return the item within 14 calendar days based on Article 37 of Law 9902, dated 17.04.2008 “On Consumer Protection”.

The item(s) ordered must be returned to the address specified by Neo Albania, with its packaging and packaging, unused and accompanied by all accessories, different instructions for use (if any), original tax receipt proving the purchase of the article. Without the ORIGINAL TAX coupon neither exchange nor return of items is allowed.

Returned products that have deficiencies, damages, are used or dirty will not be accepted by Neo Albania

The customer will be reimbursed for any costs as a result of the commercial relationship with Neo Albania

DELIVERY

Neo Albania will always try to ensure that you do not have any problems with the arrival of your shipment. The shipment will be made by a shipping company which has its own terms and conditions which vary and for which we bear no responsibility once the item is in motion, i.e. out of our warehouse. Goods may be delayed for many reasons, one of which may be force majeure, severe weather conditions, land road blockages due to works or any other type of factor that hinders the fluidity of the goods transportation process.

Risk and Ownership

The items will be at your risk from the time they are delivered to you. The moment you make the payment, you become the owner of the item(s) received.

Price and Payment

Although we take care to ensure that all prices posted on our portal are correct, there may be instances of pricing errors. If we identify these errors in the product you have ordered, we will notify you as soon as possible, and the order will be canceled immediately and if you have made any payment for this order, this payment will be refunded immediately.

The prices displayed on our portal for all advertised items include VAT but do not include any other delivery costs. Shipping cost will be included at the bottom of the order depending on the location to which the order will be shipped.

Returns/Exchanges

If you want to return an item/items within the period mentioned in point 7 of these Terms, you can only return the item via courier to the Neo Albania warehouse. The shipping costs for returning the item will be yours if the item meets all the conditions of its physical condition but you are returning it because you don’t like it or change your mind about the order placed. In case the item is damaged or physically not the same as what you ordered then the shipping costs for returning the item are our responsibility and will be covered by us.

Please note that if you want to return the item, you must have taken care of it while in your possession. This means that you must keep the original packaging, wrappers or any other information and supplementary papers that came with the item.

Exchanges can happen with items of the same/higher value (you will hand over the money difference to the courier when he brings the item) or lower (the courier will hand over the item and the money difference).

Privacy Protection

Neo Albania protects and respects your privacy and personal data based on Law 9887, dated 10.03.2008 “On the Protection of Personal Data” as well as the relevant by-laws.

The processing of your data will only be in the service of delivery security, will be regular and without delays. Also, your personal data will be used, with your consent, in sending various offers, promotions and draws that will be organized by our site www.neoalbania.com. Our customers have the right at any time to refuse the communication of promotional offers from Neo Albania.

Intellectual property

You agree that all intellectual rights, trademarks and patents in all parts of the Neo Albania online portal will always be owned by Neo Albania. You are not allowed to use any part of these materials, logos, colors, shapes, photos, descriptions of anything else for your business and personal purposes without the approval of Neo Albania. Transfer of Rights and Obligations

The contract between us and you will remain between us and you.

You may not transfer, authorize or delegate the contract to another party without our written consent.

We may transfer, authorize or delegate the contract to another party. For the avoidance of doubt, such transfers or authorizations shall not affect your rights or void, reduce or limit any warranties that may be included in the items you have purchased.

Events Outside Our Control

We will not be responsible for any delay caused by force majeure. As mentioned above but now Force Majeure includes any event that prevents the transfer of the item from us to you, which is beyond our control. Such Force Majeure includes:

Various strikes

a. Civil protests, invasion, terrorist attacks, war or threats of war in a particular region.

b. Fire, explosions, storms, floods, earthquakes, epidemics or other natural disasters.

c. Impossibility of using land routes.

d. Impossibility of using the telecommunications network.

e. Regulations, laws and by-laws that may govern a particular region or that may change in the future limit our ability to ship the ordered item.

f. Strikes by the transport company or accidents and inability on their part to fulfill the order.

Agreement between us

These Terms and Conditions represent the agreement between us in relation to any contract we may have together. This contract supersedes any prior oral or written communications we may have had.

Our right to change these Terms and Conditions

We reserve the right to revise and replace these Terms and Conditions from time to time. You will be bound by the Terms and Conditions in effect at the time you place your order.

Law and Jurisdiction

The Terms and Conditions are regulated and interpreted in accordance with the legislation of the Republic of Albania.

Disputes between Neo Albania and the Client regarding the implementation of these Terms and Conditions will be resolved by the Court of the Judicial District of Tirana.
